LivingPod Terms and Conditions of Use

1. Eligibility (Strict Age Limitation)

Access to LivingPod is strictly limited to individuals who are 16 years of age or older. By using this Service, you represent and warrant that you are at least 16 years old. If you are under 16, you are not permitted to download, register for, access, or use LivingPod in any capacity. LivingPod reserves the right to terminate or delete any accounts or content found to be in violation of this age restriction.

2. Invitation-Only Access & Content Policy

• LivingPod is a Beta, invitation-only social connections platform. Only users who have received an official invitation may use the app.
• Users who were not formally invited and attempt to create or share content may have that content removed at our sole discretion, particularly if it is not aligned with our quality or community standards.
• Even invited users must uphold the community's values; content found to be misleading, offensive, or below acceptable quality standards may be deleted without notification.

3. User Conduct

You agree not to use the Service to:

• Post unlawful, harmful, abusive, or defamatory content.
• Violate any applicable laws or third-party rights.
• Impersonate individuals or organisations, or mislead others.
• Harass, spam, interfere with, or disrupt service operations.

4. User Content Ownership & License

While you retain ownership of the content you create, by posting it on LivingPod, you grant us a non-exclusive, royalty-free, worldwide, sublicensable license to use, store, display, publish, and distribute your content as needed to operate and promote the Service.

5. Account Responsibility

You are solely responsible for safeguarding your account credentials and for all activity conducted through your account. Notify us immediately of any unauthorised access or breach.

6. Termination

LivingPod may suspend or terminate your access at any time without prior notice if:

• You violate these Terms,
• Are found to be under 16,
• Use the platform without a valid invitation, or
• Post content that is inappropriate or non-compliant with our policies.
• You violate these Terms or any applicable laws, or
• You are suspected of infringing any copyright or intellectual property rights.

6a. Account Requirements and Termination

To maintain a safe and authentic community, LivingPod requires all users to upload a profile photo. Accounts without a profile photo may be suspended or terminated at our discretion. Users will be notified and given a reasonable timeframe to update their account before termination. Livingpod also reserves the right to suspend or terminate accounts that violate our Terms of Use, for fraudulent activity, or for any other reason as deemed necessary to protect our platform and community.

7. Service Changes

We reserve the right to amend, modify, or discontinue all or any part of the Service without notice or liability.

8. Privacy

Use of LivingPod is subject to our Privacy Policy, which outlines how we process and protect your personal information.

9. Changes to Terms

LivingPod may update these Terms periodically. Continued use of the Service after any revisions signifies acceptance of the updated Terms.

12. Copyright and Intellectual Property Responsibility

• You may only post content (including text, images, audio, and video) that you fully own or have lawful permission to use.
• By submitting or posting content to the platform, you affirm that it does not infringe on any third-party copyrights, trademarks, or intellectual property rights.
• You are solely and legally responsible for any copyright infringement arising from your use of the Service. If you are found to have posted infringing content, you may be subject to legal action by the rightful owner(s) and fully liable for any damages, penalties, or claims.
• LivingPod reserves the right to remove alleged infringing content without notice and terminate repeat offenders in accordance with applicable law.

14. Account Security

You are responsible for maintaining the confidentiality of your login credentials. You agree to notify LivingPod immediately in the event of any unauthorised account activity.
